1. Acceptance and Parties

These Terms of Service ("Terms") form a contract between Inversiones Salgado Matamoros S.A., operator of the IkiHomes platform ("IkiHomes", "we", "us", "the Platform"), and the person who accesses or uses the Platform ("you", "the user").

By checking the acceptance box during signup, or by using the Platform, you represent that you have read, understood, and accept these Terms and the Privacy Policy. If you do not agree, you may not use the Platform. We keep a record of the version of the Terms and Privacy Policy in force at the time of your acceptance.

2. Definitions

  • Platform: the IkiHomes website, agent portal, and services at the ikihomescr.com domain.
  • Agent: a user with a real estate agent account who publishes properties and manages leads.
  • Buyer: a person who searches for properties, sends inquiries, requests visits, or posts buyer requests.
  • Listing: a property advertisement created by an Agent.
  • Lead: a record generated when a Buyer performs an explicit contact action on a listing.
  • Pro: the paid subscription that unlocks conversion features for Agents.
  • Share token: a secure link that allows sharing a private listing.

3. Service Description and IkiHomes's Role

IkiHomes is a technology platform that connects Buyers with real estate Agents in Costa Rica. IkiHomes facilitates property discovery, communication, and visit coordination.

IkiHomes is not a real estate agency, is not a real estate broker, and is not a party to any real estate transaction between Buyers and Agents. We do not guarantee the closing of any deal, the generation of leads, or any commercial outcome. Any contractual relationship regarding a property is exclusively between the Buyer and the Agent (or the owner the Agent represents).

4. Eligibility

To use the Platform you must be at least 18 years old and have legal capacity to contract. When registering as an Agent, you represent and warrant that you are authorized to conduct your real estate activity under applicable Costa Rican regulations and that the information you provide is accurate.

5. Registration and Account Security

You are responsible for keeping your credentials confidential and for all activity under your account. You must notify us immediately of any unauthorized use. We may suspend accounts with compromised credentials to protect the Platform.

6. Agent Obligations

As an Agent, you agree to:

  • Publish accurate, current, and non-misleading property information.
  • Have the right or authorization to market each property you list.
  • Respond to Buyers professionally and promptly.
  • Comply with applicable real estate, tax, and consumer protection regulations.
  • Be solely responsible for the content you publish and your dealings with Buyers.

7. Buyer Obligations

As a Buyer, you agree to provide accurate contact information, to use the Platform lawfully, and not to use Agents' data for purposes other than your legitimate interest in a property.

8. User Content and License

The Agent retains ownership of their content and material (photos, videos, text, listings, and reviews). IkiHomes does not claim ownership of that content.

Representation and warranty: the Agent represents and warrants that they own the rights to, or are authorized over, all content and material (photos, videos, text) they upload, and that such content does not infringe third-party rights (intellectual property, copyright, trademarks, or image rights).

License: the Agent grants IkiHomes a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and adapt that content in connection with the operation, promotion, and public display of the Platform, while the content is published and for operational purposes (backups, caching, moderation).

Indemnification: the Agent holds IkiHomes harmless against any third-party claim of infringement arising from the content they uploaded.

IkiHomes may moderate, hide, or remove content that violates these Terms, the law, or third-party rights.

9. Pro Subscription

Pro is a paid subscription that unlocks conversion features for Agents (buyer request response, lead management, private sharing, analytics, and conversion workflow), as described on the Platform. Features included in each plan may be adjusted; material changes will be communicated per Section 20.

The Pro subscription renews automatically at the end of each billing period until you cancel.

10. Payments, Pricing, and Taxes

  • The Pro plan price is displayed in US dollars (USD) as the primary currency, with a Costa Rican colon (CRC) reference where applicable.
  • The displayed Pro plan price is VAT-inclusive: value-added tax (13%) is already incorporated into the price you see. The electronic invoice will break out the VAT amount separately, in accordance with Costa Rican tax regulations.
  • Payments are processed via ONVO (card). Manual payment via SINPE or other enabled methods is also supported; in that case, plan activation may require manual verification.
  • We issue an electronic invoice for each payment as required by applicable regulations.

11. Cancellation and Refund Policy

You may cancel your Pro subscription at any time from the portal.

  • On cancellation, you keep Pro access until the end of the period you already paid for. At the end of the paid period, the account moves to the Free plan. Private listings can no longer be shared, private links are invalidated, and public listings exceeding the Free plan limit may move to draft or limited visibility based on quality, freshness, and Platform rules.
  • No refunds are issued for partial or unused periods. Payment for the current period is non-refundable.
  • To the extent permitted by applicable law, payments for the current period are non-refundable once Pro access has been activated. If any consumer protection rule grants a non-waivable right of withdrawal or refund, IkiHomes will honor it in accordance with that rule.

12. Incorporated Platform Rules

By using the Platform, you accept the operating rules incorporated by reference, including:

  • Lead creation: leads are generated only on explicit Buyer contact actions (contact form, WhatsApp, visit request, availability question).
  • Message retention: message content is retained for 12 months.
  • Share tokens: private listing share links have a limited lifetime and are invalidated on loss of Pro.
  • Buyer request visibility: Buyer data is shown in tiers according to the Agent's plan, to protect Buyer privacy.
  • Badges and trust: response times and trust signals are computed and displayed per the Platform.

Listing quality: IkiHomes may limit, hide, unpublish, reject, or send to review any listing that is incomplete, misleading, contains contact details outside the permitted fields, has insufficient or low-quality photos, appears to be duplicated, is outdated, infringes third-party rights, or harms trust in the Platform.

13. Prohibited Conduct

The following are prohibited, among others:

  • Automated data extraction (scraping) or circumventing technical measures.
  • Sending spam or unsolicited communications.
  • Manipulating the referral system (for example, self-referral).
  • Circumventing the lead system or Platform flows.
  • Sharing Buyer data with third parties without consent.
  • Impersonating others or posting false information.

14. Intellectual Property

The IkiHomes brand, software, design, and all Platform elements are owned by IkiHomes or its licensors and are protected by law. No rights are granted to you over them other than use of the Platform under these Terms.

15. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available". We do not warrant that the service will be uninterrupted or error-free, nor do we guarantee the generation of leads or deals.

To the extent permitted by law, IkiHomes shall not be liable for dealings, agreements, or disputes between Buyers and Agents, nor for indirect, incidental, or consequential damages. Nothing in these Terms limits the rights that consumer protection law (Ley 7472) grants to consumers on a non-waivable basis.

16. Indemnification

You agree to hold IkiHomes harmless against third-party claims arising from your content, your use of the Platform, or your breach of these Terms, to the extent permitted by law.

17. Term and Termination

These Terms apply while you use the Platform. You may terminate your account at any time (see account deletion in the Privacy Policy). We may suspend or terminate your account for breach of these Terms. On termination, the data retention and deletion rules described in the Privacy Policy apply.

18. Suspension for Breach or Non-Payment

We may suspend access to Pro features for non-payment, and suspend or restrict the account for breach of these Terms or conduct affecting Platform integrity, in accordance with the Platform's subscription lifecycle rules.

19. Data Protection

The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms and complies with Ley 8968 (PRODHAB).

20. Changes to the Terms

We may update these Terms. Material changes will be communicated by email or via a notice on the Platform, with the "Effective Date" updated. In this initial phase, acceptance is requested at signup; in the future we may request re-acceptance when the version changes materially.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Costa Rica. Any dispute will be submitted to the courts of San José, Costa Rica, without prejudice to the rights granted to consumers by law.

22. Dispute Resolution

In the event of any dispute, we will seek a good-faith resolution through direct communication. For data protection matters, the user may turn to PRODHAB. For consumer matters, the user may turn to the National Consumer Commission (Comision Nacional del Consumidor).

In case of conflict between the Spanish and English versions of these Terms, the Spanish version prevails.
